This store sells and ships exclusively to addresses in Switzerland and Liechtenstein.

Swiss VAT note: As an Estonian company you have no Swiss UID/MWST number unless you register in Switzerland. Registration becomes mandatory once your low-value mail-order sales into Switzerland exceed CHF 100,000/year (Swiss mail-order rule). At that point you must register, charge Swiss VAT, and display the UID + MWST number above. Below that threshold, omit those two lines.

2. General Terms & Conditions (AGB / Terms of Service)

2.1 Scope

These Terms govern all orders placed through [curalp.ch] ("the Store") by consumers ("you", "the Customer") with Agentic Commerce OÜ ("we", "us"). By placing an order you accept these Terms.

2.2 Conclusion of contract

Product listings are an invitation to order, not a binding offer. Your order is an offer to buy. A binding contract is formed only when we send an order/shipping confirmation by email. We may decline any order (e.g. stock, suspected fraud, delivery outside Switzerland/Liechtenstein).

2.3 Prices

All prices are in Swiss francs (CHF) and include Swiss VAT where applicable. The price shown at checkout is the total price — no hidden surcharges. Shipping is included in the displayed price (free shipping). (Price Indication Ordinance, PBV.)

2.4 Payment

2.5 Delivery

We ship only to Switzerland and Liechtenstein. Estimated delivery: [X–Y] business days. Delivery times are indicative, not guaranteed. 2.6 Retention of title

Goods remain our property until full payment is received.

2.7 Cancellations & returns

Cancellations and returns are governed by our separate Returns & Cancellations Policy [link]. Note: Swiss law provides no statutory right of withdrawal for online purchases; any return we accept is on the terms set out in that policy.

2.8 Warranty for defects

Statutory warranty rights for defects under Art. 197–210 of the Swiss Code of Obligations apply: a 2-year warranty on new goods. You must inspect goods on receipt and notify us of any defect promptly. See the Returns & Cancellations Policy for how to claim.

2.9 Limitation of liability

To the extent permitted by law, our liability for slight negligence is excluded. Liability for death, personal injury, gross negligence, intent, and mandatory statutory liability remains unaffected.

2.10 Applicable law & jurisdiction

These Terms and all contracts are governed by Swiss substantive law, excluding the CISG (Vienna Convention) and conflict-of-law rules. Place of jurisdiction is [your seat / the Customer's Swiss domicile], subject to any mandatory consumer jurisdiction rules in the Customer's favour.

2.11 Severability

If any provision is invalid, the remainder stays in force.

3. Privacy Policy

Covers the revised Swiss Data Protection Act (revFADP, in force 1 Sept 2023). As an EU-established company, the EU GDPR also applies to our processing — this policy is written to satisfy both.

3.2 What we collect and why

Order data (name, delivery address, email, order details): to process and ship your order and provide support. Legal basis: contract performance.

Some recipients are outside Switzerland/the EU (e.g. USA, China for fulfilment). Such transfers use adequacy decisions or standard contractual clauses (SCCs) as safeguards.

3.4 Retention

We keep order and accounting data as required by law (Swiss/EU bookkeeping: up to 10 years), and other data only as long as needed for the stated purpose or until you withdraw consent.

3.5 Your rights

You may request access, rectification, erasure, restriction, data portability, and object to processing or withdraw consent at any time. Contact [privacy@curalp.ch]. 3.6 Security

We use appropriate technical and organisational measures (encryption in transit, access controls) to protect your data.

4. Cookie Policy

The Swiss FDPIC's Oct 2025 guidance treats third-party advertising/cross-site tracking (Meta Pixel, TikTok Pixel) as "intensive intrusion" requiring explicit opt-in — functionally the same as GDPR. A consent banner is required.

4.1 Banner & consent

On first visit we show a cookie banner with equally prominent "Accept all" and "Reject" options and granular category control. Non-essential cookies (analytics, advertising) load only after you opt in. You can change your choice any time via [cookie settings link].

4.2 Categories we use

Strictly necessary (cart, checkout, security): always on, no consent needed.
Analytics [e.g. Shopify analytics / GA4]: consent required.
Advertising / tracking (Meta Pixel, TikTok Pixel): consent required; these share data with Meta/TikTok for ad targeting and measurement.
